suspension of drivers license

on 5-28-2008 was charged with 2nd offense DUI and was given one year probation and 10 YEARS SUSPENSION of license. Is this not an eleagle sentence on the drivers license. and how do i go about getting this back in court and corrected???

If your second DUI conviction occurred within a period of five years from your last DUI conviction, then the law requires that your driver's license or driving privilege be suspended for "not less than 5 years." Therefore, your 10 year suspension is legal. This exact issue had two different outcomes causing a conflict in the courts of the 2nd and 4th district. However, the Supreme Court of Florida has weighed in and resolved the conflict allowing a suspension of more than 5 years for this situation.
