Legal Question in Elder Law in Florida

I am 1 of 12 kids my father passed 8 years ago alzhiemers. My mother is now in a nursing home dmentia and alzhiemers she had my 1 brother start to write checks helping her out. after she was diganosed with the demintia that is. He had a lawyer friend write up he is to handle all her legal finacial affairs right on down to her safgety deposit box. My parents had not much a few annutities accounts and samll bank account. I have asked my brother to see her checking-savings charge card activites and the annuties you know all her finacials he said he did not have to he was in charge. I believe he has used her money he was in forclosure. How do I request this legally do not I have a right as one of her siblings to see these records. Mind you I have a doctors record stting when she was diagnosed with the demintia several years before he had the paper work worked up taking charge. Where and what can I do?

Your brother is fraudulently exploiting his fiduciary duties to your mom. File a Petition to remove him as guardian and state your reasons, get a hearing date set and have him served with the papers. I suggest you get an attorney - if this is the true case, he will have to reimburse the funds otherwise he may be criminally charged.
