Legal Question in Elder Law in Florida

incompetence

Mother in Law lives in an independent living facility that provides meals. She no longer handles money in a responsible manner, loses bills, cannot keep a checkbook balanced, is noncompliant with medications and enen with showing up for meals. She is quickly draining her finances. What happens to an 88-90 year old who has no money and no place to live? Both son's have multiple medical problems and cannot handle this woman. She has tried living with both and it was absolutely miserable and destructive to the sons marriages. We need to know where to begin looking for help. At present one daughter in law deposits checks (when they are not lost) and balances the check book. She probably needs a higher level of care (which she refuses) but that will cost even more and deplete the finances quicker. There is a good chance she will outlive her money.

Re: incompetence

it sounds like your mother-in law needs a guardianship or a durable power of attorney so someone else can control her finances. I have done a substantial amount of work in this area and would be happy to set up a telephonic appointment. If you are interested please even the e-mail me your phone number
