What is the law regarding leaving an elderly person home alone. My mother is 86 years old and she is in the early stage of dementia. She refuses to leave her apartment in Brooklyn, NY. She has already fallen several times. She has several children out of state that are willing to take her in but she doesn't want to leave her place. My older brother goes over after work every evening but she's still alone during the day and late at night. We heard that some states have a law that elderly can't stay home alone. I want to know what is the law in NYC, maybe I can use the law to help convince my mom to move in with one of us.

You will need to contact an attorney in NYC to ask that question. However, in Florida when a person has become incompacitated, you can file for guardianship of that person giving you full plenary guardianship (hopefully) so that you can designate where this person may live.
