Medicaid & Property

My 86 year old Mother in law is currently in a skilled nursing facility with the posibility of having to go on medicaid. My question involves her home and property. The home is listed in her name and her sons name as record of owners. it has been this way for over 8 years. Will this property have to be sold leaving her son homeless for her to go on medicaid?

If your mother is in this situation you describe you probably need immediate legal advice regarding her Medicare eligibility. The ownership of your Mom's house may not be a problem for Medicaid eligibility. However, your Mom's entire financial picture must be evaluated to determine her eligibility for Medicaid. From what monetary source is your Mom's nursing home care being paid for. You are welcome to call me to discuss your Mom's situation in more detail. Probably not, however, your should contact an Elder Law attorney to advise you specifically after you give them all of the facts. Medicaid guidelines can be difficult to interpret and an attorney may be able to help you protect some of the assets.
