My mother in law is 86 and recently diagnosed with dementia with Lewy Bodies. She was told not to drive by the neurologist but she continues to drive. As my husband is aware of her condition, if she should injure or kill someone would he be liable. We are concerned not only for her safety but for our retirement assets.

I suggest you contact the license division and have her license removed from her. Take the vehicle and park it so she has no access to it. then you need to do a guardianship and get control of this situation. As long as you are not on her insurance you are not responsible for her insofar as accidents are concerned. If you are on her insurance policy, get your name off immediately as you would be liable.
