Legal Question in Elder Law in Florida

My mother has be living with my sister who depends on her financially wholly for she and her daughter. THey live quite lavishly and my mother who has dementia, has complained to me several times. I have reported this to dcf and it has been dismissed. I havent had access to visit or talk to her in over three years and I want to see her and have her visit her two grandsons. What can I do?

Your only recourse may be guardianship. If your mother lacks legal capacity to manage

her own affairs, a court can appoint a guardian. If your mother does not require a guardian,

she can make her own decisions. Your sister may be managing your mother's finances with a DPOA, which, if your mother is legally competent, can be revoked. Regardless, it will be

necessary for you to consider the alternatives and discuss the issues with an agency

or person experienced in these matters. You and your children have a right to pursue

these issues.
