My sister has used my mothers credit card and also gotten cards in my mothers name. There is now approximately $40,000.00 in debt on these cards.(overdue since May 2009) My mother will not prosecute my sister. She only has about $50,000.00 in investments and lives on $1121.00 Social Security. What can I do? Should she try to file bankruptcy? My mother is 85 years old.

It does not appear that you can do anything. Your mother is allowing your sister to run up debt in her name. When she dies, her assets will probably go to the credit card coompanies.
