Do I have a case??? Please advise!!

I work as a part time model and I had a photo shoot in March 2007. The photographer, who is actually well known locally and very respected, said that I was going to get $500 for the shoot and pictures on a tear sheet. It is now end of July and I still have yet to receive either.

The photographer originally told me that I would be getting paid within 2-3 months, at the latest, but it is now going on 5 months. He has answered my e-mails asking about the time frame of when I will be getting paid, but all I get from this guy are excuses. I also know the client has already paid.

The problem is that because he is such a well known and respected photographer I made the mistake of not getting anything in witting. So I don't have an actual contract stating that I was to receive the money or the pictures. Anyway, I would like some advice on what I can do to get him to pay and not have this drag out any longer. Please keep in mind that even though I don't have a contract, I do have our correspondence that CLEARLY states that he is going to pay me.

Do I have a case to bring against him and if so, how do I go about it? Thanks so much for your time and help.

It sounds like you can prove at least that you were to be paid something. I could send a demand letter; your next option would be small claims. Keep all your evidence safe so you can use it if you go to a hearing.
