Legal Question in Entertainment Law in Florida

I am a volunteer coach/parent of a cheerleader(for a NON-profit org.), this year for the first time they are telling us that our parents have to send in thier daughters original and/or certified copy of the girls Birth Certificate in order for them to compete at a Regional Level of Competition. My question is are they aloud to request this type of document? They already have a copy of the girls B/C, but they are asking for the original certified certificate.

I don't think this is a matter of law. School districts have specific rules for what documents must be produced to enroll a child in school and prove residency, but to my knowledge, there are not specific rules for what documents must be produced for a child to participate in extracurricular activities. I suggest you check your school district's rules (they will be posted on the website).

I also question why they want this documentation -- is it to prove age? If only a certain age group is allowed to compete, then it makes sense that a parent would have to provide some definitive evidence of the child's age. Anyone can make a copy (and 'doctor' it), so an original certified birth certificate is the only way to really prove the child's age.

So, the answer here is that I don't have the answer. But, if the parents won't comply, the kids may not be able to compete -- whether it is right or wrong.

No law protects one's birth certificate from disclosure. In fact, with the exception of adopted children, birth certificates are public records. As my friend, Sarah Grosse, has said, if the girls won't comply, the organization has the right to deny their participation.

Moreover, I think Sarah's right, the organization has a clear interest in making sure a girl doesn't use a doctored birth certificate to fake eligibility. I think they are allowed to request a certified or original birth certificate.
