"I have 2 daughters and have been separated from their father about a year now. ok i am currently seeing someone else which has a criminal record and has an open case in court now.can he use this against me and win custody? Evsn if this man im seeing has been like a second father to the girls and they spend more time with him than their own father ause hes never around

He may most likely use your boyfriend's criminal record and open case against him in a custody dispute; however, unless the girls' lives appear in imminent danger or if there are allegations of child abuse or sexual abuse, etc. most likely the criminal record may not have a big dent on the case. It really would ride on the nature of his open case as well as his criminal record. Also, information as to whether your boyfriend is currently employed or living a life away from crime and making a chance for the positive would help your case as well.
