Legal Question in Family Law in Florida

Since 2006 my ex-h and I have a Court approved agreement that he pays 50% of private school fees and other associated school costs. He and his new wife now want to remove my 8 yr old from the private school or have his obligation for fees waived. Is there any precedent under law to ensure he continues to provide for her pre-existing private school education?

Actually, the "precedent" is the opposite if he can show that he can no longer afford it. Otherwise, he has to live by his agreement. But if he truly doesn't have the money anymore, a judge will likely let him off the hook.
