Legal Question in Family Law in Florida
We have 50 50 legal and physical custody. In the current court order it states that if either parent is not actively involved in the child's health and education it is grounds for less parenting time. The mother of my child has not been to a single cardiology appointment, dentist appointment, or therapist appointment for our son in almost 3 years. He has had 2 truency letter come home due to her bringing him late, checking him out early, and not taking him at all. He has failed kindergarten once and is in danger of failing first grade this year. He has gone to 3 different schools due to her moving. Recently our son witnessed his mother's husband attempt to kill himself. She had left our son in his care when this occurred. The grandmother that she also leaves him with has been convicted of Aggrivated child abuse in the past. I have a meeting with an attorney this coming week but wanted to know others opinion on what the chances of me getting primary custody of our son with limited visitation. I don't want him to never see his mother but I do not want his education and health to be surprised by her having him 50 percent of the time. Or the chances of her leaving our son with her husband and something happen again
