I get 290 a month in child support and my sons father gets my son every other weekend. Is he able to claim him on his taxes and why???

No. on the tax returns it ask if you are supporting a dependent. 1. He lives with you over the percentage time period that allows you the ability to file taxes claiming the child.

2. It is probably not in your divorce decree.
