Legal Question in Family Law in Florida

My 16 year old son went to stay the summer with his dad,who has him for the

that time.Per the MSA I have primary custody.My ex has convinced him to live

with him now.Will a judge listen to my 16 yr old and let him stay with his dad?

What would happen if I signed over my parental rights? My son will be 17 in Sept

this year.It truly isn't a good idea,son received a year paid tutition in a private school he makes a's and a+s and he never did that in public school.I really need an answer soon,so as to get an attorney for this mess.

A judge may listen to your son, but it's very unlikely that a judge will let your son decide where he can live. It takes a lot more than a 16-year-old's choice to change custody.

On the other hand, if you think your son is better off living with his dad, then that decision is between you and the father. Beware, though, if you allow a custody switch, you may end up paying child support. There is no legal right for the father to "waive" child support.
