Legal Question in Family Law in Florida
My 12 year old has to stay with the noncustodial parent 1/2 of the summer per court agreement. Can she refused to go? Is it legal?

Not without court modification or agreement of the parties.
YOu should make every effort to have her go. However, if she has activities that she is involved in,you may want to go ahead and proceed with a mofidication of visitation. As she gets older, it will become more and more of a problem as she will be at an age that will define who she is. She is allowed to testify - just file the appropriate papers with the court. One of the reasons for modification is usually because the other parent will not coordinate the activities - ie cheerleaders have a camp they go to that may interfer - softball, girlscout camp, etc.
