Legal Question in Family Law in Florida

My 9 year old step daughter, has severe separation anxiety, and will not stay the night in our home, she sleeps with her mother every night at home, and is home schooled, we have asked her mother to consider getting her counseling as her father's job limits his accessibility to take her to counseling, and mom refuses, and does nothing to encourage the relationship between father and daughter. Could we get a court order for her mother to take her to counseling and for mom to go as well, as it seems her over protective parenting contributes to the child's anxiety?

I sugest you get her medical records to substantiate this issue and then file for a Petition to Modify Visitaiton, Custody and Support. (Meaning have your husband go after custody) The court can also be made to appoint a guardian ad litem and I suggest you have the court mandate that the child attend a psychiatric interview and see was the situation is. I would also get information from neighbors as to who visits the house and how often. Is the mother certified to do home schooling - just because she says she is - where are the docs for this.
