Legal Question in Family Law in Florida
i am 24 years old my daughter is 2 years old. I have no job no car no house been living with the father of hers for 9 years now and he prefers me to stay at home. We both agreed we arent in love anymore. and we are probably going to spilt up. I know i wont get the car he brought me as a gift because its under his name thats why i said i have no car,and i do have a place to stay but its about 35 miles away from him. He doesnt want to pay child support he said that if i need money to ask him but i just dont think thats fair to control it like that and he also says that i probably wont get custody because i have none of the things listed above and he does. He makes $70,000 a year and i make $0.How do i go about doing this? I really want out of this relationship but i dont know what to do because he says not to file any papers we will work things out. and if he found out that i wanted to be with a female can he use that against me. Floirda does not provide for palimony. However, if you were the child's primary caregiver, you stand a good chance at getting custody. He would have to pay child support. You should first get a decent place to live, and a source of income.
In Florida, with family law cases, depending on the parties' comparative financial resources, the Courts have the discretion to hold one party responsible for all, or part, of the other's attorney fees and costs. In other words, if the other party has significantly stronger financial resources, do not assume that you will not be able to afford to retain an attorney.
