my 33 yr old son was asked to leave my home after 6 month in Jan. 2011. the police said to evict him. the court said i can not evict because there is no rental agreement. he is stealing and destroying my property. the police said they can not do anything because he lives here

As the owner or person in control of your home, you have the right to restrict the entry on your property. Perhaps you misunderstood the term, "evict," as used by police or court, however, unless your son has some legal right which was not defined in your inquiry, you may eject him from the property and insist that he not enter or remain on the property. Police and a local court will enforce such restrictions. If you believe he poses some threat to you or your property, you may obtain a court restraining order to restrict his actions relating to you or your property. Advice: discuss with local attorney, legal aid agency, local law enforcement.

Put his stuff on the front lawn - and change the locks. If he breaks in, call the police.
