Legal Question in Family Law in Florida
after 27yrs of marriage my spouse and i are getting a divorce, we have no kids just a house
what are my chances of keeping the home, and half of the 401k between the both of us
1 Answer from Attorneys
The general rule is whatever was acquired during the marriage is marital property, which is basically 50% 50%.
How much equity is in the home? How much is in the 401K?
There is no rule as to how the Court will do the 50% 50% split.
