abandonement

My husband wants to adopt my 2 year old. The father is against it. He has not paid support for 2 years and is facing contempt of court through the DOR. He has not followed any part of the support order. His license has been suspended as well as other things. He has recently taken me to court over visitation all though he has made no previous attempts to see her prior to our petition for step parent adoption. She has no clue who he is. Does his lack of support warrant abandonement? Would I have a chance of winning a contested step parent adoption?

This is a complicated situation with many factors involved. The failure to pay child support alone is not sufficient but the failure to establish any sort of bond may be. You should definiteley seek local counsel.
