Abandonment of Payments tenant in common

On 3/22/06 My ex was arrested for Domestic Battery. I have had a restraining order since march of 06. I still am awaiting a Decent Property settlement. In the mean time for 2 1/2 yrs he has not paid one dime. Is there abandoment even though he doesn't live here. He is still responsible for 1/2 of all payments and up keep as well as 1/2 of all it will take to even put the house in sellable condition.? My son died recently and My patient and my need to get on will my life is getting almost unbarable. I am trying to keep this short but their is a lot more to it.

I am confused -- if you are waiting on a settlement, do you have an attorney handling that? If so, that attorney should advise you on this. If he isn't paying his part, you need to file the divorce and get that moving; but as for the house - - you need to keep making payments to avoid foreclosure, etc. then seek re-payment from ex (if you are entitled) through th edivorce/family court.
