Abandonment/step-parent adoption

What is the length of time of contact from the bio father before it's considered abandonment? He We have had absolutely no contact with him until a few a days ago. It's been over 3 years. Can abandonment be used in a step-parent adoption?

There is no set number of years. Several factors come into play to determine whether a spouse has abandoned his/her child. Support, visits, gifts, contact, etc. Interesting for him to pop up on the radar a few days ago after three years.

What's needed in a step-parent adoption is his consent. While he's around get him to sign off. Then he won't have to pay child support after the adoption.
