Can a absent father claim the kids on his tax return even though he hasent gave any support for them

If you do and the IRS catches up to you, this would be a federal crime and there are sanctions for this. Normally the wife who has the children the majority of the time is allowed to claim the children. YOur tax forms even ask you if you have had the dependents for a period of time and are their sole support. HOwever, if you have a Court Order that stipulates that you are allowed the children as a tax deduction then by all means.

he can however you can claim the child also and he will lose especially if he does not pay support. The IRS will certainly favor you.
