Abusive Mother and the State doesn't care

My question is this, we have been fighting the State Of Florida, CPS for over a year now. The State knows of the abuse and neglect that this two year old child is going through. My husband is the legal Father and we live approx.360 miles apart, but in the same state. He has called to talk to his son and she slaps the child so he can't talk. She has threatened us with physical harm if we try to visit the child. My husband pays his child support and we have a restraining order against this "woman". I want to know what we can do legally to the State for their ignorance in this situation. They have lied on abuse reports and I brought it to their attention. It is like they are protecting this woman instead of the child. How can we force them to take that child out of the home? They have said the child lives in inadequate housing and he's underdeveloped, and that she has mental issues. She refuses the State's help, that child should be out of the home by now. What can we do? Thank You

If the situation is this severe I would recommend filing a Petitino for Change of Custody before the Circuit Court where the child residess. I do not recommend doing this yourself! Speak with an attorney or work through Legal Aid. Good Luck.

I agree with your previous response by Robert McCall. Time is of the essence here, so retain an attorney and file this Petition for Custody as soon as possible. No child should live in this type of environment.
