Legal Question in Family Law in Florida
I accidently booked a family visit for my family and daughter during ex's visitation time. I cannot change plane tickets, we will be visiting rarely seen, elderly family etc. I have asked ex for flexibilty, offered him other times during the year to make up for time lost and he is not budging. He wants to go to mediation to solve this. In the past I have given him 2-3 extra weekends out of the year above and beyond his COed visitation. Will that help me out in a mediation or will the mediator only follow what is in the decree? Ex lives out of state, by his own doing and sees daughter about 2 months out of the year when you add up all the time, COed and extra. Thanks for your help.

The mediator will do what it takes within his or her abilities to help you settle this situation. The mediator is not bound by your prior agreement or judgment if the two of you can agree to something else. Hopefully, your ex won't be a jerk about this and will keep the children in mind first. Of course, if he refuses to bend, you get screwed. Unfortunately, as you know, he's in the right on this one.
