adopting step daughter
My husband gained custody of his 5 yr old daughter in 11/04. The mother resides in MI.Since the change of custody she has only called her 3 times, and she declined her first visitation right last month. She has been ordered to pay support,and does not have any money. I don't think she will be an active part of this childs life anymore. I don't know if she will give up her right as her mother, but from what I know of her if we say she will be released of her financial obligation, she might be willing to give up her right. Is this a hard process and how do we go about doing something like this? My husband and I have been married fours years. Thanks for your help.

This is a two step procedure requiring two separate actions. If the mother remains absent from the child's life, you may be able to achieve your goals.
You will first need to file a Petition for Termination of Parental Rights in your local circuit court. In this legal proceeding you will ask the Court to determine that the natural mother has been absent from the child's life and not contributed to the development of the minor child. The natural mother will have the opprortunity to respond and be heard by the Court. You will have to obtain personal service of the Petition upon her.
Secondly, you will then have to file a Petition for Stepparent Adoption. The Courts generally look very favorably upon these petitions and will readily grant them upon a proper case being made.
