adopting a 13 year old step son

I am little confuse. I am trying to adopt my step son in Florida. I have all the form required. but on the for FFLF12.981(B)1 Joint petition for adopting stepparent question 9 ask (The following person(s) required to consent and the conset form of affidavit of nonpaternity is attached) but in the instruction says (that this form cannot be predated) I already have the form of consent from his bio-father. what should I do?

First of all, don't do an adoption--even a step-parent adoption--without a lawyer. You're dealing with a child's life, and that's something you don't want to screw up.

But to answer your question, it's okay (at least in the counties where I practice) if your consent to adoption affidavit from the biological father predates the filing date or signature date of your petition.
