Legal Question in Family Law in Florida
adoption without consent
I know who the father of my toddler son is, but he has not been around since the baby has been born. The birth certificate is blank. I would like to know if it is possible for my husband to adopt my child without us trying to hunt down the absentee father. I'm afraid that if i don't try to find him, and do the adoption anyway, it would be considered some sort of fraud.

Re: adoption without consent
Pursue the adoption if your husband wants to be the legal father. Prepare petition for adoption, or consult with an attorney, agency, etc. Send copy of petition to last known address of biological father. If he responds and will sign a consent form, use it in the adoption. If he does not respond, go on with the adoption. Your main objective should be, and the decision of the court will be based on, what is in the best interests of the child. Having a loving, available parent is in the best interest of the child. If the biological father has never asserted any parental rights or shown any interest, spend little time and effort trying to persuade him to behave in a mature manner.
