can my live in boyfriend give the baby we are wanting to adopt his last name although the courts presently only have me listed a custodian for the child

Once the adoption is complete and you are the legal parent of the child, you are free to file a name change petition on behalf of the child and change the child's last name to any legitimate last name you desire. The only restrictions are that you can't change a child's name to avoid creditor's, avoid the police, etc.
