Legal Question in Family Law in Florida

I cant afford much for a lawyer, I could afford more,but I have been taking care of my 2 kids all year without any help from their father my husband has a lawyer and has done a great job of making me look bad in court because he is financally well off, he has removed my kids from school twice the first time moving them 4 hours away the second time moving them 2 hours away both times he refused to tell me where he took them or let me talk to them I had to find out on my own and then show up and call the cops to get them back our divorce is not final yet but we do have an order that states I am the residental parent and that the kids reside with me and he gets every other weekend I tryed to file a contempt but the judge never set a date for a hearing...Help any advice is better than no advice....Please

You need to retain an attorney that knows how to play hardball. If it hasn't happened yet, the father's deposition should probably be taken. Let's see how much he will enjoy sitting in the "hot" seat.

In Florida, with family law cases, depending on the parties' comparative financial resources, the Courts have the discretion to hold one party responsible for all, or part, of the other's attorney fees and costs. In other words, if the other party has significantly stronger financial resources, while you will still have to pay the retainer, do not assume that you will not be able to afford to retain an attorney. Reimbursement can be sought.

If you opt to proceed without the assistance of counsel, be aware that you will not be entitled to a �do over� if things go badly.

It's not the judge's job to move your case forward.

Mr. Goldstein is correct. Please try to find an attorney who can handle your case. As to setting a hearing, that is your job to call the Judicial Assistant to the judge and have her get the husband's attorney on the phone to set a hearing date. I strongly urge you to NOT do this yourself. Find a way to hire an attorney.
