Legal Question in Family Law in Florida

Age at which kids can choose where to live

When me and my husband divorced 9 years ago it was court ordered that we have joint custody of our 2 children with me having them half the week and him having them the other half. There is no primary parent. We are suppose to make all parenting decisions together. This has worked out great until now. My kids are now 14 and 17 and my husband has remarried. His wife is determined to create friction between him and the kids. She lies about things to get my son into trouble. My daughter has been the brunt of her lies as well. I have caught her in multiple lies and while I have tried to maintain peace for the kids sake, it has gotten to the point that I realize my son is under great stress and my daughter doesn't want to go to her dad's house anymore. This woman had the nerve to state to everyone that my daughter was a lesbian. My daughter has a boyfriend at present and was appalled at what was said about her. My question is---is there an age when kids can choose which house to live at without having to go through all the legal wrangling of court, lawyers, etc. Both kids want to stay with me and my husband full time. My son loves his father and loves to spend time with him alone but my ex's wife prevents that from happenin

Re: Age at which kids can choose where to live

Only at age 18 can the kids decide on their own where they will live. Prior to that the kids choice of parents is only one of many factors the court will consider.
