Legal Question in Family Law in Florida

annulment or divorce

I have been married for about 6 months and want to either get a divorce or an annulment. Is one easier or less expensive than the other?

The other lawyer is mistaken. There certainly is annulment in Florida, and I've handled many.

However, it isn't a question of whether annulment is easier or less expensive, it's first a question of whether you qualify, which you probably don't.

For a marriage to be annuled in Florida, the marriage must be void. That is, one of the parties had to be married when the instant marriage occured (in other words, it's a bigamist marriage), the parties are brother and sister, one of the parties was underage at the time of the marriage, there never was a marriage license, etc.

So, to get an annulment, the marriage must be no good. Many people think a marriage can be annulled because the parties haven't slept together. Not true. A marriage can only be annulled because it's legally improper. So the question isn't "which one to choose," it's "is annulment even available?"

If you think you are entitled to an annulment, call me or write me and I'll take you through the next step, which is, "should I seek annulment or divorce?"
