Can I get an Annulment??

I was married in March 2001. We separated one month later. We never consummated the marriage. He moved to NYC in August 2001 and haven't seen each other since. We never filed for divorce but i would like to do it now. Can i get an annulment since we never consummated?? i am engaged to someone else and would like an annulment v. a divorce.
