Legal Question in Family Law in Florida

annulments

I have been married for 3 months and my wife wants a divorce. I have not been served divorce papers as of yet. Due to the short time of marriage, am I able to get the marriage anulled and what does that entail. Thanks for your help. --name removed--Formisano

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

No, the length of the marriage is not relevant for determining whether or not an annulment will be proper. An annulment is generally only granted when the marriage is considered a fraud or sham such as for an underage person or when it has not been consummated. At this point, you will probably get a divorce unless circumstances exist to show that an annulment is proper.
