Legal Question in Family Law in Florida

Answer petition or default?

If both parties are in agreement, what is fastest way to proceed? Answer the petition or not answer and have the petioner file a default? Also, are there any implications when filing the default?

Re: Answer petition or default?

If you agree, it's an uncontested divorce. You can serve each other petition and answer by hand delivery and simply set a time for final hearing. The petitioner could actually have prepared the answer that the respondent could sign (if all is agreed).

There is no reason to go for a default. The time frame for a hearing is the same and a default could spell out later problems for one of the parties.
