Answering a Divorce Petition

Is there any way for me to answer the divorce filed by my wife by myself? I need to do this as I have not yet hired a lawyer and want to be sure to do it in time. Or maybe there is a way to file for a short extention to answer. I really want to hire an attorney immediately, but currently with my bills and the Child Support I am paying I am tight right now. I am doing some side work in addition to my full time job and plan on being on my feet in about 2 weeks, but I think that is too late to answer.

You should not answer the petition without consulting with your attorney. You may be waiving certain claims or important rights because of your lack of experience in the law. Instead, file a motion with the court asking for an extension of time to retain an attorney. Most judges will grant the extension. Even if not, it will take at least two weeks before it is heard which will provide the time you claim you need.

Yes, you can do both. Each court has a self help department. You can get forms from them. Do not delay.

You can contact your local courthouse and see whether they have a selfhelp center. Also, you can look for an attorney who takes credit cards or who will allow you to pay later for the service.

Depending on the allegations in the petition, you may really want an attorney to look at it so that you do not end up losing any of your rights. You have 20 days from the day of service to answer. This may give you enough time to get back on your feet.
