Legal Question in Family Law in Florida

Army Retirement payment, when does it stop?

I'm in the process of getting a divorce to woman living in Florida. I'm Retired from the Army, and she is entitled to a portion of my Retirement Check. The sum has been agreed to by the both of us. The sticking point is this; do the payment stop when she dies, ( of course it does, she can't take it with her, she seems to think so). Here is the big question, if she get remarried after the divorce, will the Military Retirement portion to her stop, now that she is with another to provide for her? I had calle the VA Center in St. Petersburg, FL, they are telling me it stops. The Ohio VA Regional Office says it is a state to state call. Help!

Re: Army Retirement payment, when does it stop?

Generally, such retirement benefits paid to former spouse terminate on death or remarriage; you are advised to express clear terms for such benefits in marital settlement agreement related to dissolution.
