Legal Question in Family Law in Florida

I asked a question recently about filing for full custody of my children since my husband is now living with his lover and we are not legally separated. The answer was that I can file for custody. Specifically, Can I file for full custody or does it have to be joint? Does adultry have any effect on that? Thank you!

Florida grounds for divorce ONLY are irreconcilable differences. If the adulty depleted your marial funds you can add that in your papers to be reimbursed to you. As to custody, Florida no longer uses the terms of custody, primary residential. You would be applying for shared parental responsibility/time-sharing. Anytime your are dealing with children, you should really consider hiring an attorney.
