attorney withdrawing from case

Can an attorney withdraw from your case due to Irreconcilable differances and not give you the unused portion of your retainer back?

Re: attorney withdrawing from case

You should receive a final accounting from the attorney. If there is unused pre-paid funds then you should get a refund of those funds. The attorney may be holding some funds to pay for outstanding items, or additional billable ours which have not been billed to you yet.

Read your retainer agreement (contract) for clarification on how any retainer is to be applied to your account.
