Back Alimony (Taxed)

My Ex-hubby owes Alimony. The IRS is now involved (yeah) and is taking him to court. I was asked this of someone, but I want to know myself: Can the IRS tax my alimony that is owed (court ordered) to me? Or can I recover full amount w/o penalty?

Ex was ordered $400/mo starting Dec ''09 (when divorce was finalized) and hasn't paid dime one yet

Alimony is taxed as regular income. You do not owe any tax on the alimony until you actually receive it. There will be no penalty as long as you pay the taxes owed in the year you receive the alimony. Pay taxes on it in the year you receive it and there should be no problem.
