Legal Question in Family Law in Florida

Just as a little background when my daughter was 8 months old her father and I got into an altercation and he pulled a tire iron out on me with our daughter in my arms as a result I had a restraining order against him that was for 2 years. During some of which I had full custody and he had no visitation till I filed for divorce. Then he was put on supervised visits no overnights for a year. Since that was lifted he only spent a few months of having her every other weekend from Saturday to Sunday then he got a job as a truck driver where he only saw her once a month if that, and only for one night. As of a month ago he got a new job that is in town where we resume with every other weekend. Our daughter is 5 now and he is supposed to take her from school Friday and drop her off at school Monday where I pick her up. He never does this only takes her Saturday and Sunday and does not help with any of her extra curricular activities. Well two weeks ago my daughter came home saying her dad call her dumb and that he is mean to her and leaves her home alone and he doesn't like her. At school she has been mean to other kids and I have had multiple conversations with her teacher about misbehaving. Well this weekend she was with her father on his weekend and I called to talk to her and she historically starts crying saying she wants to come home, after a long argument I picked her up and as she is running up to me says she never wants to go back and that she doesn't love her daddy and he doesn't like her and that she only wants to be with me. She has expressed multiple times that she is afraid of him getting mad at her and with his past I don't know what to think or what next steps I should take. My question is what should I do, should I seek legal counsel, put him back on supervised visits? She really seems afraid of him.

Ask the Court to change the visitation to whatever seems to be in your daughter's best interests.

You have to go back to court and get a supervised visitation order.
