Legal Question in Family Law in Florida

Background:

I live in Florida, I have a 5 year old daughter, and never married, my ex's name is on the birth certificate. My daughter's father and I ended the relationship exactly one year ago. Since then he hasn't been in either one of our lives. We don't speak I don't even know where he lives. I did file for child support shortly after the relationship ended however they haven't been able to locate him and serve him with court documents so I haven't received anything.

Do I have automatic custody of my daughter since he basically abandoned his parenting responsibilities? If I fly out of the country with my daughter ( I'm from South America and wan't to vacation there for 1 week and of course bring my daughter with me) will I have to obtain consent from him? How do I obtain consent If I don't know where he is?

Any advice would be greatly appreciated.

You will need his consent for a passport. If not, then you will need to get a Court Order. Contact my office for an appointmetnt if you are in my area.
