Legal Question in Family Law in Florida
At the beginning of 2009 I separated from my wife due to infidelity. We havent filed any paper work yet to officially divorce, and were just going to try to do things mellow for our daughter, who is 8. Not involve the courts. We seemed to be able to work that stuff out. Well just over the past couple weeks I have been finding out that my daughter is not happy there at all. In fact I now have emails from her, and between her and her aunt talking about how she is scared of her mom (who is an alcoholic), how her mom gets mad easy, and how now she is in TROUBLE for going with me when she was left in a house with pool access with SEVERAL KIDs,and the oldest only being 13, the rest about my daughters age, cause she wanted to go to the bar. (on a school night, I picked her up at 11:30 in her swim suit with no clothes with her). The police said there was nothing I could do, but I just want my daughter with me now that I see her mother is neglecting her and treating her bad. I am saving the e-mails and what not, but I need to know what I can do as a Father?and how the courts will listen to me? Should I get an attorney? Any other important pieces of advice would he helpfull since this is all new to me, and I am scared for my daughter.

Get a lawyer and file for divorce. Seek custody (it's technically called "primary timeshare" now) in your divorce. It sounds like you have a very good case for custody.
