I am getting a divorce, because my wife is in a 10 yr affair. I found out and for the past year while my divorce has been going on she has not paid any house bills.

Can you sue your spouse for bills incurred during the marraige before you get a divorce?

Yes, but you can also make the argument during your divorce that you should not be liable for those bills as a matter of "equity" (fairness). Florida, for the most part, is a community property state (meaning debts and assets get split equally), but judges in Florida are allowed to step in and take actions to equitably distribute debts where it would be unfair to make both spouses equally liable for debts. Your case may be one of those cases.

Whoa! You lasted a whole year without knowing the bills weren't paid. No forclosure, no garnishments, no phones ringing off the hook, no dunning letters. A TEN year affair and she only stopped paying the bills the last year?
