Ex is not bio-dad but is on birth certificate

My ex-husband signed a form stating he is the biological father even though he isn't. My husband now would like to adopt my children. Who do I need to send paperwork to for him to adopt them? Both the biological father (who has never had previous contact with my oldest daughter) and my ex-husband? Or just the person listed on the birth certificate? My ex-husband does not provide child support for the daughter in question. The biological father is incarsirated on a 3rd degree felony, and 4th degree misdemeanor for sexual coersion of a child between 13 and 16 years old which happens to be the same age as child in question.

Only the legal parent must consent to adoption by another. The ex who is on the birth certif although he doesn't pay support is the one to consent to the adoption. It will remove his parental rights as well as any support obligation.
