Legal Question in Family Law in Florida

biological father is not father listed on birth cetificate what are his rights

i had an affair while married and got pregnant. I believed the father of my child was my husband and recetntly did a paternity test with the alleged father and it came back positive. what rights does he have to my child? I am now divorced from my husband and want no future with my child's father. my ex-husband is aware that he is not her father. can we prevent her biological father from seeing my child? he is not a good role model for my child?(he is not listed as the father on the birth certificate)my ex-husband pays childsupport and acts like a father should. my ex-husbandhe is willing to continue to act like her father.

Re: biological father is not father listed on birth cetificate what are his righ

There was recently a major case decided by the Florida Supreme Court on a similar issue. I cannot tell from these minimal facts if it applies or not. You need to see a Family Law attorney in your area ASAP. My shoot from the hip opinion is that a court will probably have to be involved to cut off the visitation of the biological father if he tries to press the issue.
