Legal Question in Family Law in Florida

I am the biological father of my son that lives in Florida I would like to bring my seven-year-old son to my wedding but his biological mother is giving me a hard time there is no custody order. What I be breaking the law if I take my son without her consent?

If there is no legal document in place that gives you right of temporary custody or visitation or time sharing you may be risking a parental kidnapping charge, it would be more serious if the child is transported across state lines.

If there is no custody order in place and your paternity of the child has not been established through the courts, you would not want to remove the child from her care.

If you have not done so previously, you will want to file a petition to determine paternity and to establish a Parenting Plan and time-sharing schedule.
