Legal Question in Family Law in Florida

The biological father of my unborn child would like to relinquish all rights. This way when the baby is born my now husband can sign the birth certificate or go thru the necessary steps to have him placed on it. What legal documents or procedure would we need in order to do so?

In order to relinquish your parental rights a Petition to Terminate your Parental Rights must be filed. The court will only terminate parental rights if there is a pending adoption. The petition must be filed in the county where the minor child lives or where the adoption is going to take place. After there is a formal termination hearing then a separate action for adoption must be filed.
