Legal Question in Family Law in Florida
My boyfriend just found out that he may have a child
My bf and I are having our baby tomorrow. A couple of days ago he got a call from an old friend informing him that his ex gave birth to his child a year ago and never even told him she was pregnant. He has since contacted the mother of this child and she claimed she put unknown on the birth certificate and never told him about the child because she didn't want to. She had no intentions of ever telling him about his son. My bf is so upset that he has missed out on over a year of his child's life. We know that the first step is to get a paternity test but my bf is afraid of the financial consequences of taking the test and having to pay a child support payment that we can't afford or even back child support. With our new baby arriving tomorrow there is absolutely no money in our budget to make child support payments. I know that if we had the money he would gladly make payments. Can she sue him for back child support when he didn't know he had a child? Can he sue her for a year lost with his son? How are child support payments figured in Florida? Do you think it would be beneficial to work out visitation/child support with her without involving the courts if she is willing to do so?

You have posed alot of questions. You could contact my office and I could adress some of your concerns. And, yes, its always cheaper to do it without attorneys and court intervention, but unfortunately it does not always work that way.
